When you receive mental health services from Lapeer County Community Mental Health Services, the Michigan Mental Health Code and other laws safeguard your rights. At the time you begin to receive mental health services, and at periodic intervals thereafter, you will be given information about the rights guaranteed to you by Chapter 7 and 7A of the Mental Health Code. You are encouraged to ask questions about your treatment and about your rights. You are further encouraged to make suggestions that you feel are in your best interest. If you believe your rights have been violated, you should inform the Rights Office staff and/or file a Recipient Rights Complaint.
Once the Rights Office received a Recipient Rights complaint, the Rights Office staff will review the Complaint and may investigate the allegation. In the event the allegation in the Complaint is substantiated, the Rights Office Staff will make recommendations about remedial action to the provider of services. Additionally, Rights Office staff can assist consumers of mental health services by advocating on their behalf or by facilitating contact with external agencies when situations exist that are outside of the jurisdiction of the Rights Office.
After an investigation into a complaint is complete, a consumer, his or her guardian, the parent of a minor consumer or the person who made the complaint, has the right to appeal the decision if: (1) the findings of the investigation are inconsistent with the law, facts, rules and policies or guidelines; (2) the action, or plan of action, is inadequate; or (3) the investigation was untimely. Rights Office staff can assist individuals with filing an appeal or facilitate contact with an external agency for appeal assistance.
